The finding rests on an independent Panel of Experts, which ruled unanimously that Duterte can understand the charges, understand the purpose and consequences of the proceedings, follow their course, understand the evidence, and instruct counsel in preparing and conducting his defence. The chamber said its decision was based on the panel's findings and on submissions from the parties and participants.
The panel did not describe Duterte as free of medical problems. It found some physical and mental slowing consistent with his age and frailty. But it found no evidence of a worsening mental state or cognitive abilities, and reported that his general physical health appeared to have been optimised — possibly, it said, because of the standard of medical and nursing care in detention.
That finding sits directly against the defence argument. Duterte's lawyers had contended that he suffers from cognitive decline affecting memory and daily functioning. The panel's assessment did not support that account. The chamber also adopted measures to facilitate his participation in the proceedings.
Duterte, 81, faces charges of murder and attempted murder as crimes against humanity related to his war on drugs. If convicted, he faces a maximum sentence of life imprisonment. He has not been convicted of anything, and the fitness ruling is not a finding on the charges.
The ruling clears the main procedural barrier to the first trial of a former Philippine head of state before the ICC. It also moves the legal contest off his health and back onto the substance of the drug-war killings.
Duterte appeared in person at a hearing in September 2026 after a year detained at The Hague. He did not speak, and sipped water throughout.
